Payroll Cycle
In the United States, employers use different pay periods, such as:
During the pay period, the employee's worked hours are tracked, and their pay is calculated based on their hourly rate or salary, along with any overtime, bonuses, and deductions for taxes, insurance, or other benefits. The final amount is then given to the employee through a paycheck or direct deposit.
Employer Taxes
8.27% to 33.65% depending on the state
Overtime Pay
The Fair Labor Standards Act (FLSA) defines overtime as hours worked by a non-exempt employee beyond the standard 40-hour workweek. For instance, if a non-exempt employee works 50 hours in a week, they're owed 10 hours of overtime pay. Local overtime pay regulations may differ by job and state.
Sometimes, hours worked outside the regular schedule are called overtime, even if the weekly total is under 40 hours. While the FLSA doesn't require overtime pay in such cases, some states may mandate it after eight hours in a day. Employers may also choose to reward extra hours worked as a goodwill gesture, even if not legally required.
Paid Leave
No federal law in the United States guarantees paid family or medical leave. However, there have been significant proposals, including one that gained approval in the U.S. House of Representatives as part of the Build Back Better Act, which builds upon the longstanding Family and Medical Insurance Leave (FAMILY) Act proposal.
Currently, eleven states, including California, Colorado, Connecticut, Delaware, Massachusetts, Maryland, New Jersey, New York, Oregon, Rhode Island, and Washington, as well as Washington, D.C., have enacted paid family and medical leave laws.
Sick Leave
The Family and Medical Leave Act (FMLA) allows for a maximum of 12 weeks of unpaid leave in specific medical situations for either the employee or a member of the employee's immediate family. Nonetheless, in many cases, paid leave can be used instead of unpaid FMLA leave.
Public and Provincial Holidays
There are no federal holidays that mandate all businesses to close. Federal holidays apply mainly to federally chartered and regulated businesses, government contractors, and Washington, D.C. Other public holidays are determined by individual states, with many states permitting local jurisdictions to establish their own holidays. Consequently, holiday regulations have traditionally been state-based, and federal law doesn't dictate business operating hours.
Notice Period
Since the majority of employment in the U.S. operates on an at-will basis, there is no mandatory notice period. Typically, however, many employees choose to give a two-week notice in practice.
13th Month Bonus
The United States does not mandate 13th-month pay, but it is a common practice for U.S. employers to offer year-end bonuses to their employees.
